What the rule actually says
Food establishments in Suffolk are inspected under the Virginia Food Regulations. The certified food protection manager requirement, 12VAC5-421-55, reads:
"At least one employee with supervisory and management responsibility and the authority to direct and control food preparation and service shall be a certified food protection manager, demonstrating proficiency of required knowledge and information through passing a test that is part of an accredited program."
The regulation also exempts some establishments — those serving only non-time/temperature-control-for-safety food, and those that only reheat or cold-hold commercially processed, fully cooked foods (and do not cool them). - The regulation requires passing a test that is part of an accredited program. It does not require you to sit in a particular room. Our exam is part of the ANAB-accredited Always Food Safe program and is watched live by a proctor. If your inspector has raised a concern about remote proctoring specifically, get it in writing and send it to us — we will not tell you it can't happen.
- Usually not. The exam needs enough bandwidth for a stable video connection, and a phone hotspot is often enough. Tell us beforehand and we will sanity-check it with you rather than discovering it mid-exam. If the connection drops we stay with you instead of voiding the attempt.
- It depends on what you actually do with food. The regulation exempts establishments serving only non-time/temperature-control-for-safety food, and those that only reheat or cold-hold commercially processed fully cooked food without cooling it. A stand selling whole produce and packaged goods sits very differently from one cooking and holding hot food. That is a determination for the Western Tidewater Health District, not for us.
